為了規(guī)范互聯(lián)網(wǎng)信息服務(wù)活動(dòng),促進(jìn)互聯(lián)網(wǎng)信息服務(wù)健康有序發(fā)展,根據(jù)國(guó)務(wù)院令第 292號(hào)《互聯(lián)網(wǎng)信息服務(wù)管理辦法》和工信部令第33號(hào)《非經(jīng)營(yíng)性互聯(lián)網(wǎng)信息服務(wù)備案管理辦法》規(guī)定,國(guó)家對(duì)經(jīng)營(yíng)性互聯(lián)網(wǎng)信息服務(wù)實(shí)行許可制度,對(duì)非經(jīng)營(yíng)性互聯(lián)網(wǎng)信息服務(wù)實(shí)行備案制度。未取得許可或者未履行備案手續(xù)的,不得從事互聯(lián)網(wǎng)信息服務(wù),否則就屬于違法行為。

什么是前置審批? What is the pre-approval?
前置審批是指企業(yè)注冊(cè)成立或者增加經(jīng)營(yíng)項(xiàng)目涉及到需要政府部門(mén)審批的項(xiàng)目,必須經(jīng)過(guò)有關(guān)部門(mén)的許可后方可注冊(cè)成立或者開(kāi)始經(jīng)營(yíng)。
根據(jù)《互聯(lián)網(wǎng)信息服務(wù)管理辦法》第5條等有關(guān)規(guī)定,擬從事新聞、出版、教育、醫(yī)療保健、藥品和醫(yī)療器械、文化、廣播電影電視節(jié)目等互聯(lián)網(wǎng)信息服務(wù),根據(jù)法律、行政法規(guī)以及國(guó)家有關(guān)規(guī)定應(yīng)經(jīng)有關(guān)主管部門(mén)審核同意的,在履行備案手續(xù)時(shí),還應(yīng)向其住所所在地省通信管理局提交相關(guān)主管部門(mén)審核同意的文件。擬從事電子公告(也就是論壇、bbs)服務(wù)的,在履行備案手續(xù)時(shí),還應(yīng)當(dāng)向其住所所在地省通信管理局提交電子公告服務(wù)專項(xiàng)備案材料。

Enterprises engaged in electronic bulletin service (which is the forum, BBS), should be submit an electronic bulletin service special verification files to the local communications authority.
